We have just heard from traders in Niecon Plaza (opposite the Wave), that the new leases have a new demolition clause: the plaza can be demolished on 6 months notice. Prior leases had the standard demolition clause, but only operative after a long period, like 5 years. Now only on 6 months notice! And we wondered why so many shops in the plaza are empty. Now we know. THIS MUST MEAN that developers are getting ready to construct a high rise directly opposite the
Wave, on its east side, only 20 meters away (on top of old CBA/Niecon Plaza site). They already have council approval for this, but with the new city council plans, there are no height restrictions anymore. Once building starts, apt values in the Wave will be down by at least 50%. Why take the risk? Better to buy in the Oracle or Jewel (or Synergy, for cheaper prices).

On the way to Zimbabwe and Victoria falls

A few months after that mysterious episode, we tried to rekindle our romance and sex life again, but it was very hard for us to catch up where we had left off. There was like a dark cloud hanging over us for a few months. By then we were both so tired of the place, we could not wait to go to South Africa, and then back to Pattaya, our base.
Doctor tried to cheer me up by planning a trip to Zimbabwe for three days. I cooked rice, with grilled pork chops, vegetables, salad and fruit. It was our romantic getaway. We left Lusaka at 7 a.m. to drive to the Victoria Falls in Zimbabwe, which took about 6 hours. 
On the way we passed many small villages; we saw women carrying water on their heads and babies on their backs. The small village markets were impoverished, with not much to sell. I felt sad to see the hardship these poor farmers had to endure. It made me feel homesick – my family was also struggling as farmers. Doctor knew I was down again, so he played music such as ABBA, Simon & Garfunkel, and bought coloured stones for souvenirs. It was sweet of him and romantic.

Then half-way through journey, about 11.30 a.m., he said, “Let’s stop here for a picnic.”
I said, “Oh no, we are in the middle of nowhere.” We had not seen a soul for a long time. I was scared and excited. As we started to eat, I realized that I had forgotten to bring rice. It was only us in this huge landscape, only bushes around us. We sat underneath a beautiful tree, the breeze cooling us.
This vast empty wilderness was absolutely serene, silent, thrilling, romantic - we could hear our own breathing and hearts beating. It was like something from “Out of Africa”. All we could hear were the sounds of cicadas and crickets, like a permanent buzzing-sound in the background. It was eerie.
Before we crossed the border, we visited Kariba Dam on the Zambezi River, and an ostrich farm.
Help! – baboon invasion!
After we crossed the border, we checked into the Victoria Falls Hotel at 4 p.m. The hotel was very quiet. Tourism was depressed. Doctor told me that in the past, when the country was named Rhodesia, it was known as the “Jewel of Africa”. After the long trip, we were enjoying a bubble bath, relaxing in the bathroom. Doctor had left the bedroom window open with a small gap for air, while we were in the bathroom.
Suddenly we heard a loud crashing and banging coming from the bedroom - I opened the bathroom door a bit to see what the hell was going on! After all, we were the only ones in the room, weren’t we?
Then I saw two huge baboons in the bedroom fighting each other over the remains of our picnic lunch. While thus engaged (or arguing), I saw three smaller-ones tucking into the remaining pork chops, bread, cheese and cold ham on one bed. On the window sill, some more were eating my grapefruit. Wow! - were they enjoying our picnic lunch! Must be the best feast they ever had. I screamed in terror!
Doctor yelled, “What the fuck is going on?!”
I screamed, “There are baboons in the room! Oh my God, we have been invaded!” I was frozen with fear.
Doctor jumped out of the bath, stood at the bathroom door, yelled to chase them away; they just ignored him, continuing the feast. They only started to back out of the room and window when doctor started throwing things at them, like toothpaste and soap; one picked up the soap, gave it a lick, and immediately fled out the window. After a few minutes, they all had left in disgust, taking the remains of our picnic lunch with them.
Don’t tell me baboons prefer bananas – they love tomatoes, cheese and pork chops! Clearly they enjoy a variety of foods, just like us, their distant (how distant?) cousins.
It was not a very nice welcome for us. Having survived the baboon invasion, we got dressed and prepared to visit the falls. We went down to the ground-level coffee shop which, like the hotel, was surrounded by trees. We saw that the trees were full of hungry baboons of all sizes – they outnumbered humans (the locals and tourists).

Customers had to protect their purchases by holding their food or drinks in their hands with a tight grip, or a small baboon could come swooping down from the branches and grab it. It was an amazing sight. Hotel staff told us that “baboon invasions” in hotel rooms were common, which is why the windows have signs saying “do not open the windows”. Doctor complained that this sign did not say what could happen if the windows were opened!

Chapter 51
The Wave – mother of all battles, biggest case in Australian history! (the full chapter is 10 pages)

Sued by the Wave body corporate committee – the ugly
While we were still in the middle of the Oracle trade-mark battle, on 12 April 2011 the Wave body corporate (through its committee) approved legal action against us for $5,500 on account of arrear levies. This related to one levy for $2,750 (due 1 December 2010), and one due 10 April 2011 – just two days before legal action was authorized. The body corporate’s committee acted in bad faith. It is likely that the Piconi Group (the Wave onsite agents) was also behind the legal action, as it had been trying to get our apartment to manage since mid 2006.
Magistrate prejudiced: ignores the correct policy
Our argument was that the Wave body corporate and/or SSKB had not acted reasonably in refusing our payment plan proposals. Their only defense was that the Wave had a policy of “zero tolerance” to owners’ arrears. We produced evidence from an official minute of a body corporate meeting, and SSKB policies, that the correct policy is “zero tolerance except in mitigating circumstances as agreed by the committee”.  (See copy from minutes, at the end of this chapter.)
We said the impact of the Queensland floods on our business was a mitigating circumstance (the whole Gold-Coast tourism sector had suffered). Apart from evidence of our income being down drastically, we also had as evidence an article in the Bulletin quoting the Minister of Tourism stating (on 2 February 2012) that the flood damage to the tourism industry in Queensland was “the worst in living memory”. The presiding magistrate, Duroux, told doctor: “This is not evidence. Do you believe everything you read in newspapers?” I was shocked – right there from the start this guy was prejudiced against us.
Prejudiced magistrate denies us a fair trial
On 18 October 2012, when we still had 6 (out of 8) witnesses to cross-examine, the Wave’s barrister made a motion to restrict our cross to end that same day. Duroux then (still under Frigo’s spell) made an order that we finish our cross the next day. We were furious. We had already spent part of 2 days on the cross of 2 witnesses, without any objection from the magistrate or the plaintiff.
Doctor stood up, banged his fists on the table, saying this is an ambush; we can’t cross 6 witnesses in one and a half days! The magistrate just shrugged his shoulders, implying “too bad, so sad, what do I care”, and said we must decide what to do. Doctor said, “Your honor, there is no justice in your court.” We asked for permission to leave, which was granted. We then left the proceedings…………..…………………………………………………..

Judgment: legal costs $150,000
The next day, on 19 October 2012 (in our absence), the magistrate made an order that we pay recovery costs by then a total of $150,000. He based his judgment mainly on the claim that the policy was “zero tolerance” to owners’ arrears, whereas he knew perfectly well that the policy was “zero tolerance except in mitigating circumstances”. 
How can one have confidence in this kind of a magistrate, and this legal system? The plaintiff got another execution warrant to seize and sell our apartment. We didn’t care - we couldn’t pay these legal costs, we just wanted to keep increasing them. We also hoped, of course, through subsequent appeals, that Duroux’s judgment would be overturned. But we had to stop the warrant for $150,000 being executed. …………………………………………..
Lose to another prejudiced judge - now in Federal Magistrates Court 
We argued that Duroux had not complied with civil procedure rule 367, requiring us to have a fair trial. This is the Rule: 367 Directions:  (2) In deciding whether to make an order or direction, the interests of justice are paramount. 367(4) in deciding whether to make an order or direction of a type mentioned …  the court may have regard to the following matters: (a) that each party is entitled to a fair trial or hearing; (h) that each party must be given a reasonable opportunity to lead evidence and cross-examine witnesses; (j) another relevant matter.” Regarding the latter, Duroux also ignored the fact that we were self-represented.
Instead of letting us leave the court before our evidence was presented, he should have advised us (in the interests of justice) to first present our evidence and be cross-examined on it. He would then have had both sides of the argument (this of course would not have had any influence on this prejudiced magistrate – he was against us from the start, but we would have had stronger grounds of appeal). He ignored the Rule’s requirement for justice. We did not get a fair trial - this is especially important, as we were self represented, with no barrister representing us.
Now appeal higher - to Federal Court in Brisbane

My feelings about all this litigation: Oracle & The Wave  
My view is that in all the cases, the judges did not read our affidavits and submissions, believed everything from the plaintiffs’ barristers (all music to their prejudiced ears), and did not take into account the merits of our arguments or the needs of justice.
For them, self-represented litigants like us are just a nuisance and a problem. I know that in court, judges and magistrates have to be addressed as “your Honor”. I am not in court, so I address them differently. In my opinion, they do not deserve respect. They should be called, “Your Dishonor”………………………..
Don’t invest in the Wave Broadbeach!
An increasing number of overseas investors are coming to Australia, and the Gold Coast. I advise everyone: do not invest in the Wave. The City Council has plans for a high-rise building to go up right in front of the Wave, on the east side. This will effectively destroy all ocean views East – which is the direction the Wave faces! The GFC put the plans temporarily on hold - the high rise will definitely go up in the next few years.
The GC Bulletin (front page, 17 June 2014) says that the city council’s draft city plan provides that there will be no height limits on new buildings in suburbs including Broadbeach. The Wave is 34 floors. The one in front could be 30 or more floors.
Lessons for investors – avoid shark-infested Crook Coast
Think about the movie, the good, the bad and the ugly. Here in the Crook Coast, apart from my husband and I, there are no “good”. All bad or ugly. In my experience, the Crook Coast is full of sharks in the ocean, in the canals and on land. They seem to thrive here. Must be the sea air. Investors

No manners, no justice, nothing
Since I have been living in Australia I have been too scared to drive our small Toyota hatchback (the BMW is too intimidating, doctor will be chewing his nails). Drivers here want to cause accidents. If one say turns into oncoming traffic where it would have been better to wait a bit, oncoming drivers flash their headlights angrily (often making rude signs as well) – they never slow down. If one crosses a road when it is safe but maybe slightly risky, don’t think that drivers will slow down – they keep going at the same speed. Jump for your life! “Defensive” driving does not exist in their mentality. It’s part of the culture. Pedestrian crossings are death traps. 
No justice
About a year ago the Gold Coast Bulletin had a report about a retired airline pilot, apparently 70 years old. He approached a pedestrian crossing; instead of breaking, he accelerated, killing the pedestrian. The court’s decision: an honest mistake, guilty but no sentence (maybe a few months suspended). The amazing thing was that his license was not even suspended – he is free to kill again. Beware of pedestrian crossings. Don’t assume drivers will stop.
The same newspaper on 23 October 2013 (its page 3) reported that a motorist named Jacob took his eyes off the road for “just over 4 seconds”, hit a light pole and killed a cyclist waiting to cross the road. The judge sentenced him to 18 months, parole after 4 months; disqualified from driving for 2 years. The judge “accepted that he was a young man who now bore extreme guilt for his momentary lapse of attention”.
Can you believe this injustice? The guy’s license was already suspended - he should not have been driving in the first place. It is reported that he was led away to jail “in front of his tearful family”. How sad. The killed cyclist’s family was too upset to attend the sentencing. They must have been even more upset when they found out what the sentence was. This kind of crazy sentencing happens here all the time. Australia is the place where you can “get away with murder” (i.e. killing people).  
Aggression, no manners
There’s aggression everywhere – in sports, on the road, in business, in relationships. It’s a dog eat dog environment. Maybe we shouldn’t live here after all. But we are stuck here because of business and book-publishing commitments. Also, I am busy with my second book.
Most Aussies simply don’t have any manners. The receptionist at Broadbeach on the Park had an operation on her foot, and was limping painfully to her boyfriend’s four wheel drive vehicle, some 20 meters away from the lobby. Did he get out to help her get in? No way - he just sat there, while she struggled to open the door and ease her way in. Typical.
If I politely hold open a door, or a lift door, so that others (maybe with a pram or parcels) can go through, do you think they say thanks? No way. So I stopped doing this a long time ago. On the very rare occasions when someone holds a door open for us, doctor says, “Thanks. Are you from New Zealand?”
Many Aussies also have a tendency to walk on top of one, like they walk too closely behind one, sometimes stepping on the end of one’s thongs (sandals). Of if we stop suddenly, they crash into us. They don’t look where they are walking, or don’t walk where they are looking.
Another bad habit I have found is space invasion. Many, when talking to us, stand far too close to us. It’s like the nearer they stand, the more physical dominance they have (especially as I am shorter than most of them). Spittle showers. Give me Kiwis anytime! Also, most Aussies have not learned to cover their mouths when eating, yawning or coughing. I have seen countless examples of them scratching their private parts in public, picking their noses.
No culture
Apart from an absence of manners, most Aussies have no culture. Well, they do have a culture, which consists of aggressive behavior, both sexes getting covered in tattoos (now called “body art), a love of violent contact sports, bar brawls, drink-soaked BBQs, excessive drinking generally, and bad language. This applies to both sexes, of all ages. On the positive side, based on surveys, compared to other countries, a far higher-percentage of Aussie couples stay together. It must be because of the “culture” they share.
And hoons! These mostly younger people convert their motor-car exhausts so that they can roar around everywhere, especially late at night, making a huge noise. The police do nothing about this. 
Gold Coast is controlled by the bikers!
Amazingly, large parts of the Gold Coast economy, including Broadbeach (where we live), is controlled by bikers (i.e. local Mafia). Yes, huge guys, covered in tattoos, belonging to many biker gangs, like Bandidos, Finks, Nomads. The following from “news.com.au” (part of the Murdoch empire) on 3 August, 2013, under the heading “Bikie nation - the outlaw gangs in your backyard”: “But it is the Gold Coast which has become a major hub for bikies and organised crime with traditional gangs like the Finks, Bandidos, Black Uhlans and the Nomads joined by new clubs like the Brotherhood, and the Cruisers”. The Casa Nostra would steer clear of these guys. Recently the Finks have joined up with the Mongols (from the USA)…………………………..

Bandidos in Broadbeach – gang warfare
A typical example of public exposure to them was on 4 October 2013, when 60 Bandidos got involved in a fight with another gang outside a restaurant in Broadbeach’s main restaurant area, full of holiday makers, women and children, terrifying them all. Suddenly the area was full of cops. Some bikers were arrested, none jailed. All a show, the show goes on. ………………………….
Daniel Meers, a reporter for the Gold Coast Bulletin, writing about that incident, said that all the cops achieved, after a massive presence, was one person without a driver’s license. Yeah! Great victory. He writes that the cops put on a big PR show, and then everything goes back to normal. Exactly……………………………………..
Delinquent 4-5 year olds
I see in the Gold Coast Bulletin 13 September 2013, an article that the Gold Coast’s prep students (age 4-5) are officially the naughtiest in Queensland. “A record 156 tiny terrors were suspended from schools in the south-eastern region last year for biting, punching, kicking, throwing objects and swearing”. Imagine, being suspended from school already at that age. No wonder so many grow up to be aggressive, and lacking in manners. Maybe something to do with their ancestors?

This 2 two-brm apartment is in the newest and most luxurious development in Broadbeach (and the Gold Coast!) – the twin towers of the Oracle. As the Oracle resort is superior to other resorts in the area, apartments in the resort are a bit more expensive.

PRIVATELY OWNED & MANAGED

These apartments are privately owned and managed. Our office is at 2503, 89 Surf Parade, Broadbeach. We live in the resort so can provide a personal service. We meet and greet you personally in the lobby when you check in and take you to your apartment.

Note that we do not provide a daily “mini service” – one reason why we can be cheaper than the onsite manager. There is no mini-bar in the apartment – but there is a huge liquor store just across the road!
